NLC Queries (20/01/15)



I've had lots of enquiries from readers in North Lanarkshire and without identifying people by name, for obvious reasons, here are some typical points that are being raised.

Q. Has the Council made serious proposals this time around?

A. Yes, it has and the Employment Tribunal has been postponed to allow the parties to see if these proposals can be hammered into a final package which can potentially resolve all the outstanding issues.

Q. Why did we not just proceed with the Employment Tribunal?

A. Because all tribunals carry a degree of risk and not every issue is guaranteed to be decided in the claimants' favour. So it makes sense to consider any serious proposal put forward by the Council and negotiate a settlement where possible.

Q. What happens if the settlement talks with North Lanarkshire fail?

A. If A4ES cannot reach a fair settlement of peoples' claims, then clients are no worse off and in that event will be heading straight back to the Employment Tribunal. We will have lost some time, obviously, but the there is no doubt that our success at the tribunal and the ongoing FoI campaign has forced the Council to wake up, smell the coffee and 'get real'.
